James is a licensed attorney in California and Hawaii, with 40 years' experience in antitrust/unfair competition, trust litigation and public interest litigation, including Native Hawaiian rights litigation. He was admitted to practice before the United States Supreme Court, California Supreme Court, Hawaii Supreme Court, Third Circuit Court of Appeals, Ninth Circuit Court of Appeals, U.S. District Court for the Northern District of California, Central District of California and the Eastern District of California, and U.S. District Court for the District of Hawaii. James has also worked with U.S. top antitrust lawyers on numerous cases—Frederick P. Furth, John Boone, Joseph L. Alioto and Joseph M. Alioto.



Significant Cases

  • Co-counsel in precedent-setting case: Clayworth v. Pfizer, Inc., 49Cal.4th 758, 765 (2010)
  • Co-counsel with former Mayor of San Francisco, Joseph L. Alioto, from 1989 to 1998, in numerous cases which included trust litigation and antitrust litigation
  • Recommended trade policies and legislation to China as a U.S. Delegate (selected by U.S. Attorney General) to U.S./China Joint Trade Session on Trade, Investment and Economics Law, in Beijing, China
  • Advised Native Hawaiian indigenous groups for 20 years regarding Hawaiian religion/cultural practices and rights regarding land in Hawaii
  • Co-counsel in precedent-setting 2002 case which established Hawaiian access rights to private property, including 27,800 acres in Wao Kele O'Puna Rainforest on the Island of Hawaii
  • Lead counsel for 10 years in major trust litigation to enforce beneficiaries' rights in multiple cases conducted in Hawaii, Oregon, California and Minnesota
  • As trustee, managed three substantial trusts, including all aspects of administration of trust funds, managing diverse investment portfolio, accountability for profit and loss, oversight for approximately 30 lawyers in Washington, D.C., Ohio, Texas, Oregon, Hawaii and California
  • Counsel for Pharmacy Defense Fund (members include 3,000 retail pharmacists) in antitrust cases including Brand Name pharmaceutical price-fixing litigation from 1997 to 2014
  • Plaintiff antitrust class actions: pharmaceutical drugs, Microsoft, automobile, LCD, airlines
  • Lead counsel in precedent case against U.S. Postal Service which established contractual right to sue for postal workers: Miles v. US. Postal Service (91 h Cir. 1977) 561 F .2d 1348
  • Co-counsel in case establishing objective standards for welfare recipients against City and County of San Francisco
  • Lead counsel in litigation against City of Petaluma which successfully preserved watershed property on Sonoma Mountain range in Sonoma County, California
  • Lead counsel in trust litigation resulting in substantial benefit increases for beneficiaries and relocation of trust situs from Minnesota to California
  • Assisted in formation of a Hawaiian foundation to promote Hawaiian culture and Hawaiian rights on the Island of Molokai
  • Assisted in an action against the United States to secure private property owners right to deny public access to Puko' o Lagoon on the Island of Molokai, Hawaii. See Boone v. US. , 944 F .2d 1489 (CA 9 (Hawaii) 1981)
  • Assisted in cases involving preservation of Hawaiian religious/cultural practices; preservation of rights to Hawaiian lands; protection of Hawaiian sacred sites
  • Assisted in establishing relocation rights for displaced residents against San Francisco Redevelopment Agency
  • Assisted in obtaining low income housing for displaced residents in South of Market against the City and County of San Francisco


Injunctive Relief Obtained

  • Obtained injunction prolonging time to vote for three hours against City and County of San Francisco
  • lnjunction against City and County of San Francisco compelling payment of welfare checks without deductions for food stamps
  • Injunction against Campbell Estate on the Big Island of Hawaii requiring Native Hawaiians access to Wao Kele O'Puna Rainforest on Big lsland of Hawaii
  • Injunction against Safeway, lnc. on behalf of independent gas station owners enjoining Safeway from use of Safeway card to obtain discount at Safeway gas stations
  • Injunction against trustee on behalf of beneficiaries regarding misuse of trust assets in various trust litigation cases
